For married couples, part of the process of reaching agreement on separating the marital finances is looking at how the children will be provided for. This can include consideration of the accommodation that each parent has or will receive and it can also look at monthly maintenance.
However, in some circumstances, often those involving the separation of unmarried parents or where one parent has significant income, where specific financial arrangements may need to be made which are instead of or in addition to the arrangements as between the parents.
Schedule 1 of the Children Act 1989 allows for an application to Court to be made for financial provision for children. The Court then has the power to consider a range of options that take into account the needs of the child including any disability, the financial resources of the parents, and any private education provisions that are already in place or have been planned.
